Manodhairya Yojana (revised): help for victims of rape, child sexual abuse, acid attack and attacks with flammable substances

In simple words

Money and support for women and children in Maharashtra who have suffered rape, child sexual abuse, an acid attack, or an attack with petrol, diesel, kerosene or cooking gas, and for girls under 18 rescued in police raids under the Immoral Traffic (Prevention) Act.

What you may get

Up to Rs 3 lakh in most cases, and up to Rs 10 lakh in the most serious cases (permanent mental or physical disability, gang rape with serious injury, death, or serious disfigurement or permanent disability from an acid or flammable attack). Rs 30,000 for medical treatment is sanctioned within 7 days of the papers reaching the authority, and the rest within 120 days. 25 percent is paid at once and 75 percent is kept as a 10 year fixed deposit.

Who it is for

A woman or child who is a victim of rape, an offence under the POCSO Act, an acid attack, an attack with a flammable substance, or a girl under 18 rescued in a police raid under the Immoral Traffic (Prevention) Act.

Main eligibility conditions

• The case must be one of the listed offences, registered with the police.
• An FIR, a first medical report and the victim's statement recorded before a magistrate are checked before money is sanctioned.
• Help is not decided by the court's final verdict.
• The victim is expected to stay consistent with the statement given before the magistrate. If a false statement or false claim is proved, the money can be recovered.
• The scheme applies from 1 January 2024. It is not backdated, except for some older pending cases covered by High Court orders.
• The money goes to a bank account in the victim's own name (in the guardian's name for a minor). The account must meet KYC rules.

Conditions we could not check

• A First Information Report (FIR), a medical report and a statement before a magistrate are needed. In serious cases the legal services authority can allow an exception for the statement.

How to apply

1. The police investigating officer sends a copy of the FIR and other papers by email or other means, within 1 hour, to the District Legal Services Authority (or the State Legal Services Authority) and the District Women and Child Development Officer.
2. The One Stop Centre gives immediate medical and counselling help. Free medical treatment is available in government, municipal and private hospitals under this scheme.
3. The legal services authority decides the help. The information given about the victim is kept confidential.
4. You can also contact the District Legal Services Authority of your district. This page does not list a phone number because the GR does not.
